CODICIL FORM

Who should use this form?

This codicil form is intended to be used by those who are domiciled in Scotland and who wish to leave Cramond Kirk a legacy to be used for its general purposes. If you wish to leave your legacy for a specific purpose it may be best to consult your solicitor (and you may wish to take independent legal advice in any case). If you do not have a solicitor the Finance Convenor can put you in touch with a Solicitor who can help. The Church of Scotland Law Department (lawdept@churchofscotland.org.uk) is always prepared to help with wording to ensure your legacy is used as you would wish.

How to complete this codicil form.

Following these instructions carefully will help to ensure that your codicil is valid.

If you have made more than one will it is important to ensure that your codicil relates to your most recent will. To avoid confusion, it is also important to identify clearly whether this is the first codicil to your will, or the second, etc.

1 Sign your name in ink in the presence of a witness (who must be over 16) who should add his/her name, address, occupation and the place of signing (in ink) on the codicil. Both of you must be present while each of you signs. 

The following people cannot witness your codicil:

    Your executor

    A beneficiary of your will

    Your executor’s spouse

    A beneficiary’s spouse

2 Date the back of the codicil form

3 It is important that the original will and codicil are kept together but not attached to each other. Attaching the codicil to your will even with a paperclip, could mark the paperwork and cause problems when your will is read.

4 Send or give a copy of the will and codicil (in a sealed envelope if you prefer) to your executor or a trusted friend. Indicate with a note where the originals are held
